JUDGMENT
Petitioners 1 and 2 are the trade unions of various
employees like petitioners 3 and 4, who are permanent
employees with the 1st respondent Company. Respondents 3 to
23 are stated to have been appointed in the 1st respondent
company on a daily wage basis, allegedly through back door.
The petitioners contend that when the afore respondents 3 to
23 were sought to be regularised, they were before this Court
on an earlier occasion and by Ext.P2 judgment, the stand taken
by the 1st respondent company that, at that point of time, there
was no decision taken to regularise the services of the
temporary employees was taken note of and permitted the
petitioners to approach appropriate authorities, if need arises.
2. The petitioners contend that, subsequently, pursuant
to Ext.P3 communication by the company addressed to the
Government during July, 2019, a decision was taken to
regularise the services of respondents 3 to 23 and it is in that

circumstances that the captioned writ petition is filed by the
petitioners.
3. Heard Sri.Blaze K. Jose, the learned counsel for the
petitioners, Sri.M.P.Joseph, the learned Standing Counsel for
the 1st respondent, Sri.T.Jayan, the learned Government
Pleader for the 2nd respondent, Sri.Manu Govind, the learned
counsel for respondents 3 to 23 and Sri.Krishnakumar V.M., the
learned counsel for additional respondents 24 to 27.
4. Sri.Blaze, the learned counsel for the petitioners,
would invite the attention of this Court to Ext.P4 promotion
policy finalized by the Government to show that, if the
regularisation as proposed takes place, the future prospects of
the members of petitioners 1 and 2 will be defeated.
5. However, the learned counsel for respondents 3 to
23, Sri.Manu, submits that, at present, out of the 21 employees,
five have already left the services of the 1st respondent, and as
regards balance 16, they sought for regularisation from the
company, citing various subsequent judgments rendered by the
Apex Court.

6. This Court notices that, while rendering Ext.P2
judgment, a learned Single Judge of this Court had left open the
right of the rival parties to seek regularisation as well as to
challenge regularisation, citing appropriate reasons.
7. In such circumstances, especially since the complaint
alleged in this writ petition is with respect to regularisation of
employees who have admittedly put in more than 20 years of
service, I am of the opinion that, ultimately, it is for the
Government to consider and take appropriate decisions in that
matter.
In such circumstances, this writ petition would stand
disposed of, directing the 2nd respondent herein to have a
decision arrived at on Ext.P3, after hearing all the stakeholders
including the petitioners 1 and 2, respondents 3 to 23 as well
as additional respondents 24 to 27, within a period of eight
weeks from today.
The Government would extend a fair opportunity of
hearing and would also take into account the various written
submissions to be made from the side of the respective parties.
The Government to consider the submissions made with

reference to Ext.P4 as well as the judgments of the Apex Court
in Secretary, State of Karnataka and Others v. Umadevi
and Others [(2006) 4 SCC 1), Jaggo v. Union of India
[2024 INSC 1034] and Shripal and anr v. Nagar Nigam,
Ghaziabad [2025 INSC 144].
