                           ORDER

This Criminal Miscellaneous Case is filed to quash

the proceedings in Crime No.459/2016 of Melukavu

Police Station which according to the petitioner is now

pending before the Judicial First Class Magistrate

Court, Erattupetta.

2. The above case is charge sheeted alleging

offence punishable under Section 75 of the JJ Act r/w

34 IPC. It is submitted that the entire dispute

between the petitioners and the victim are settled.

The defacto complainant is the father of the victim.

He filed an affidavit stating that he has no grievance

against the petitioners and he has no objection in

quashing the proceedings. The victim, who is now a

major, also filed an affidavit stating that he has no

grievance against the petitioners and he has no

objection in quashing the proceedings. It seems that

the 1st petitioner is completely bed-ridden due to

paralysis. Considering the facts and circumstances of

the case and also considering the fact that the entire

dispute is settled between the parties, the

continuation of the proceedings against the petitioner

is not necessary.

Therefore, this Criminal Miscellaneous Case is

allowed. All further proceedings against the

petitioners including the final report in Crime

No.459/2016 of Melukavu Police Station which is now

pending before the Judicial First Class Magistrate

Court - I, Erattupetta are quashed.
