                             ORDER

This criminal revision petition is filed against the order

dated 28.10.2017 in Crl.M.P. No.505/2016 in S.C.No.766/2015

passed by the Assistant Sessions Court (Principal), Palakkad, by

which a petition submitted by the petitioner for discharge is

dismissed. Petitioner is the accused in S.C.No.766/2015 on the

file of the Assistant Sessions Court (Principal), Palakkad. The

above case is charge-sheeted alleging offences punishable

under Section 304 read with Section 34 of the Indian Penal

Code and Sections 184 and 185 read with Section 188 of the

Motor Vehicles Act.

2. The prosecution case is that on 19.09.2014 at 6 pm,

the 1st accused being the driver of the Jeep bearing Registration

No.KL-11/E-8433 drove the said vehicle under the influence of

alcohol in a rash and negligent manner so as to endanger

human life and hit one Praseetha who later succumbed to the 2024:KER:73650 CRL.REV.PET NO. 1406 OF 2017

said injuries. The 2nd accused abetted the said act of the 1 st

accused is the submission. Thus it is alleged that the accused

committed the aforesaid offences. Annexure-A is the FIR and

Annexure-B is the final report. According to the petitioner who

is the 2nd accused in the case, even if the entire allegations are

accepted, no offence is made out against him. Therefore the

revision petitioner filed an application under Section 227 Cr.P.C.

to discharge the petitioner. The learned Assistant Sessions

Judge dismissed the same. Aggrieved by the same, this criminal

revision petition is filed.

3. Heard the learned counsel for the the revision

petitioner and the learned Public Prosecutor.

4. Annexure-B produced along with this revision

petition is the final report in the above case. The allegation in

Annexure-B final report is extracted hereunder:

ഇരുന്ന് വണ്ടിയോടിച്ച് യാത്ര ചെയ്യുന്നതിന് 1-)o പ്രതിക്ക് പ്രേരണ

നൽകിയും പ്രോത്സാഹിപ്പിച്ചും, മദ്യലഹരിയിൽ പബ്ലിക്

റോഡിലൂടെ വാഹനം ഓടിച്ചുപോയാൽ ആളുകൾക്ക് 2024:KER:73650 CRL.REV.PET NO. 1406 OF 2017

അപകടമുണ്ടായി മരണം സംഭവിക്കും എന്ന അറിവോടുകൂടി

വർഷങ്ങളായി നിയമാനുസൃതമുള്ള ഡ്രൈവിംഗ് ലൈസൻസ് ഉള്ള

മേപ്പടി 1-)o പ്രതി സുഭാഷ് മേപ്പടി വാഹനം അതിവേഗതയിലും

നിയന്ത്രണമില്ലാതെ വെട്ടിച്ചുവെട്ടിച്ച് ഓടിച്ചുകൊണ്ടുപോയി

ആയക്കാട് സ്കൂളിന് മുൻപിൽ വച്ച് ഏതോ പെൺകുട്ടിയുടെ ദേഹത്ത്

മുട്ടിച്ചും തുടർന്നും ടി ജീപ്പ് നിയന്ത്രണമില്ലാതെ വെട്ടിച്ച് വെട്ടിച്ച്

ആളുകൾക്ക് ഭയംജനിപ്പിക്കുന്ന രീതിയിൽ ഓടിച്ചുകൊണ്ടുപോയി

ആയക്കാട് മന്നം ബസ്റ്റോപ്പിന് സമീപംവെച്ച്, ബസ്സിറങ്ങി

വീട്ടിലേക്ക് റോഡരികിലൂടെ നടന്നു വരികയായിരുന്ന ആയത്തുപാട

ത്തുള്ള ബാലൻ മകൾ പ്രസീതയെ ഇടിച്ചു തെറിപ്പിക്കുകയും സ്ഥല

ത്തുള്ള ആളുകൾ മരണഭയം കൊണ്ട് ഓടി രക്ഷപ്പെടുകയും ടി

വാഹനം വീണ്ടും മതിലിൽ കൊണ്ടിടിച്ച് വീണ്ടും തിരിഞ്ഞുപോയി

പരിസരത്തു നിൽക്കുന്ന KL-49-C-8505, KL49 E 1837

ഓട്ടോറിക്ഷകളിൽ ഇടിച്ച് കേടുപാടുകൾ വരുത്തുകയും തുടർന്നും ടി

ജീപ്പ് ആൽത്തറയിൽ കൊണ്ടുപോയി ഇടിച്ചു നിൽക്കുകയും

ചെയ്തിട്ടുള്ളതും ഗുരുതരമായി പരിക്കുപറ്റിയ പ്രസീത തൃശ്ശൂർ അശ്വതി

ആശുപത്രിയിൽ എത്തിച്ചതിനുശേഷം ചികിത്സ ഫലിക്കാതെ

മരണപ്പെടുകയും ചെയ്തിട്ടുള്ളതിനാൽ 1-)o പ്രതിയും 2-)o പ്രതിയും

കൂട്ടുത്തരവാദിത്വത്തോട് കൂടി കുറ്റകരമായ നരഹത്യ ചെയ്തിട്ടുള്ള

തിനാൽ പ്രതികൾ മേൽവകുപ്പുകൾ പ്രകാരമുള്ള കുറ്റം ചെയ്തിരി

ക്കുന്നു എന്ന്."

5. A perusal of the above would show that the 1 st

accused was the driver of the vehicle. The allegation against 2024:KER:73650 CRL.REV.PET NO. 1406 OF 2017

the petitioner is that the petitioner abetted the 1 st accused for

committing the offence. This Court in State of Kerala v.

Sreeram Venkittaraman [2023 (3) KHC 221] considered the

offence of abetment. It will be better to extract the relevant

portion of that judgment:

"26. Section 107 IPC deals with the offence of abetment. It requires instigation or engaging in a conspiracy for doing an illegal act or intentionally aids the doing of an act or illegally omits to do an act to enable the commission of an offence. The decision in Kashibai and Others v. The State of Karnataka (2023 LiveLaw (SC) 149) is apposite in this context. There is not an iota of material to indicate that the second accused had intentionally aided, instigated or conspired with the first accused to commit the offence. Providing the facility for driving a vehicle without anything more cannot amount to abetment. It is not enough that an act on the part of the alleged abettor happens to facilitate the commission of the crime. Intentional aiding, and therefore active complicity is the gist of the offence of abetment under the third paragraph of S.107, as observed by the Supreme Court in Shri Ram v. State of U.P [(1975) 3 SCC 495]. Viewed in the above perspective, this Court is of the opinion that the offence of section 188 of the MV Act cannot be charged against the second accused in the nature of the materials collected by the investigation.

Therefore she is entitled to be discharged for the said offence. The order of the learned Sessions Judge refusing to discharge the second accused is liable to be set aside. "

6. Keeping in mind the above dictum, this Court perused

the final report and also the statement given by the witnesses

cited by the prosecution under Section 161 Cr.P.C. I am of the

considered opinion that, the admitted prosecution case will not

amount to the offence of abetment by the petitioner to commit

offence under Section 304 IPC. Therefore I am of the considered

opinion that Section 304 IPC is not attracted based on the

allegation as against the petitioner. But I make it clear that this

finding is not applicable to the 1 st accused and the case of the 1 st

accused is to be considered separately in accordance with law.

7. In addition to Section 304 IPC, the offences Sections

184 and 185 of the Motor Vehicles Act are also alleged in the

final report. Therefore, I am of the considered opinion that the

impugned order can be set aside and the matter can be sent back

to the trial court for fresh consideration about the materials

against the petitioner to attract any other offence except Section

304 IPC.

Therefore, this criminal revision petition is allowed with

following directions:

1. The order dated 28.10.2017 in Crl.M.P.

No.505/2016 in S.C.No.766/2015 on the file

of the Assistant Sessions Court (Principal),

Palakkad is set aside.

2. The Assistant Sessions Judge (Principal),

Palakkad, is directed to reconsider the

matter and find out whether any other

offence is made out against the petitioner to

proceed with the case against him, except

the offence under Section 304 IPC.
