JUDGMENT
The writ petition has been filed seeking correction
of the name of the petitioner in her Class X and Class
XII certificates (Exts.P2 and P3), changing her name from
"Nidhi" to "Nidhi Jaidev Vadakkekkara" and also the
school records maintained by the 1st and 2nd respondents.
2. Though notice was issued to the parties, the
school has chosen not to appear through counsel.
Standing Counsel appears for 1st respondent. The
Standing Counsel has filed a statement stating that no
application has been received either from the petitioner
or from the school for change of the name.
3. The counsel for the petitioner points out that in
Ext.P6, which is the application submitted through WP(C) NO. 16011 OF 2024
proper channel before the school, it has been endorsed
that the request to the CBSE will be forwarded within
three days and it appears that the same has not been
done.
4. In the above circumstances, this writ petition is
disposed of directing the 2nd respondent to forward
Ext.P6 application to the 1st respondent along with
relevant documents at the earliest, at any rate within
two weeks from the date of receipt of a copy of this
judgment. On receipt of the application, the 1 st
respondent shall consider the same in the light of the
decision by the Hon'ble Supreme Court in Jigya Yadav
v. CBSE [2021 (3) KLT 711 SC] and pass necessary orders
within six weeks thereafter.
