JUDGMENT
The issues involved in all these writ petitions are
interconnected and they are being heard and disposed of together.
2. The petitioner herein is one L.V. Sinesh, who was
appointed as Physical Education Teacher in the High School section
of St. Xavier's High School, Peyad from 15.07.2013. The
educational authorities approved the appointment. According to
the petitioner, there was no sanctioned post of Physical Education
Teacher in the U.P. Section of the school since 15.07.2013. This
writ petition was filed praying to quash Ext.P13 order, whereby the
petitioner was directed to work on a clubbing arrangement with
St.Joseph's U.P. School, Pottayilkada. He also seeks a declaration
that he is entitled to continue in the lone sanctioned post of
Physical Education Teacher in the High School section of the St.
Xavier's Higher Secondary School, Peyad.

3. The petitioner, C.S. Shaji Symon, was appointed as a
Physical Education Teacher in the High School section of the St.
Xaviers Higher School, Peyad with effect from 24.06.2013. The
educational authorities did not approve the appointment. As per
the Government Orders on the subject, the staff fixation for the
academic year 2010-11 was ordered to be continued till the end of
the academic year 2015-16. In the staff fixation done during April
2016, it was found that the post of Physical Education Teacher in
U.P. Section was in excess in 2013-14 and has to be abolished.
Based on Government Order dated 29.01.2016, the Manager
proposed to retain Sri. L.V.Sinesh (7th respondent herein and
petitioner in WP (C) 16552 of 2019) by clubbing arrangement with
another School under the management. The above proposal was
rejected by the Deputy Director stating that approved Teachers
alone can be permitted to continue under the clubbing
arrangement with another school under the management. The
appointment of the 7th respondent was later approved by Ext.P2
order dated 28.12.2016. The Corporate Manager issued Ext.P4
order, whereby the 7th respondent was ordered to continue in the
post of Physical Education Teacher in the U.P. section on clubbing

arrangement with St. Joseph's U.P. School, Pottayilkada and the
petitioner was appointed as Physical Education Teacher in High
School section. The 7th respondent challenged Ext.P4 and the 1st
respondent found that the 7th respondent, being senior, was
entitled to appointment to the post of Physical Education Teacher
in High School and for approval in the said post, consequent to the
reduction of the post of Physical Education Teacher in U.P section
during 2013-14. The copy of the order is produced as Ext.P5.
Ext.P5 was challenged before this Court. The 7 th respondent also
approached this Court for implementing Ext.P5 order. This Court
set aside Ext.P5 order and directed the 1 st respondent to
reconsider the issue. The 1st respondent thereafter issued Ext.P11
order on 02.09.2019. The 1st respondent found that the posts that
were permitted in 2010-11 were available at the time of
appointment of the petitioner and Sri.Sinesh and since the posts
were permitted to be continued till 2015-16, both of them are
entitled to protection. However, since both of them continued till
31.03.2019, it was ordered that they be approved in the posts
where they were continuing till then and thereafter from
03.06.2019, Sri.Sinesh shall be appointed in the High School

section and the petitioner shall be appointed on a clubbing basis.
Ext.P11 has been challenged in WP(C) No. 24556 of 2019.
4. This writ petition has been filed by the petitioner in
WP(C) 16552 of 2019 and the prayer is for implementing Ext.P11
order dated 02.09.2019, (Ext.P11 in WP(C) No.24556 of 2019).
The question hence to be decided is the correctness of Ext.P11
dated 02.09.2019.
5. Heard both sides.
6. The counsel for the petitioner in WP(C) No.24556 of
2019 submitted that Sri Shaji Symon and Sri.Sinesh were entitled
to protection since their appointments were before 2015. As per
the interim order in WP(C) No.24556 of 2019, Sri Shaji Symon
was permitted to continue in the post. It is stated that he
continued in the High School section till the staff fixation of the
current academic year. It is submitted that even though the salary
was being paid pursuant to the interim order, it was not being paid
fully and the benefits of pay revision and increment in the revised
scale etc. have not been paid. The counsel submits that even if
the writ petition is dismissed, the respondents are bound to pay
the salary for the period during which the petitioner has worked.

It is further submitted that in the staff fixation for the current year,
the post of Physical Education Teacher in the High School section
has been reduced, and Sri.Shaji Symon has been ordered to be
deployed to GVHSS, Malayinkeezhu. It is hence submitted that,
Sri Shaji Symon can no longer claim any relief in WP(C) No.24556
of 2019. It is submitted that another writ petition has been filed as
Writ Petition No.30768 of 2022 claiming salary, etc. in the revised
scale.
7. The counsel appearing for the petitioner in WP(C)
Nos.16552 of 2019 and 4804 of 2020 submits that as far as his
client is concerned, there is a necessity to decide on the validity of
Ext.P11 Government Order. It is submitted that, Sri Sinesh was
appointed in a regular vacancy on 04.06.2012. The said vacancy
was in the High School section. It is submitted that the
appointment was approved in 2016. On 06.06.2019 Sri Sinesh
was put on clubbing arrangement. The above order was
considered by this Court in Ext.P6 judgment produced in WP(C)
24556 of 2019. Taking note of the contentions of Sri L.V.Sinesh,
that being the senior most teacher, he is entitled to be
accommodated against the regular vacancy, and that the legality
of the clubbing arrangement has not been considered by the

Government, this Court directed the Government to reconsider the
aspects and pass orders.
8. The counsel for Sri Sinesh relied on the judgment of a
Division Bench of this Court in Rani George V Deputy Director
of Education (2004 KHC 75). Reference was made to
Paragraph 32 of the judgment wherein this Court laid down the
legal principles. This Court held as follows:
"32. In view of the legal principles discussed above, it is held
as follows:-
(i) If the educational agency is having an Upper Primary
School and a High School or a High School with Upper
Primary in the same district, both sections shall be treated as
a single unit.
(ii) The seniority of the specialist teachers working in such
units shall be prepared in accordance with R.37 treating the
abovesaid U.P. Schools and High Schools as a Single unit.
(iii) The post of specialist teachers in the abovesaid
schools/sections are interchangeable.
(iv) The post of the specialist teacher attached to the High
School is not a promotion post of the specialist teacher
working in the U.P. School or U.P. Section of High School.
(v) In case of any post of a specialist teacher in such a unit
is to be abolished, the service of the junior specialist teacher
in the combined seniority list is liable to be terminated even
if he/she is working in the High School subject to the
provisions of R.51A of Chap. 14 Κ.E.R.

(vi) A senior teacher working in the U.P. Section has no legal
right to claim that he/she shall be transferred and posted in
the High School on the ground of seniority alone.
(vii) The Educational Agency is having the right to transfer a
specialist teacher working in the U.P. Section to High School
of the same unit or vice versa subject to the Rules."
9. It is submitted that if the U P Section and the High
School Section are treated as separate single units, Sri.L.V Sinesh
will have to be approved in the High School section. The counsel
also referred to the decision of this Court in State of Kerala and
Others V Sri. G.Sajeevan and Another (2007 KHC 5733)
wherein another Division Bench of this court had considered the
interchangeability of the posts in the High School section and U.P.
Section. The Division Bench endorsed the principle laid down in
Rani George (supra). On considering the arguments of the
counsel on either side, it is evident that in Ext.P11 the
Government has found that both Sri Sinesh and Sri Shaji Symon
are entitled to protection. The order considers the fact that Sri
Sinesh, being senior, was entitled to be appointed to the High
School section.
10. In the above circumstances, I do not find anything
wrong in Ext.P11 order issued by the Government, since it is as

per the law laid down in Rani George (supra). The challenge
against Ext.P11 order raised in WP(C) No.24556 of 2019 is hence
rejected and it is ordered that Ext.P11 order is liable to be
implemented, as sought for in WP(C)No.4804 of 2020. No orders
are required in WP(C) No.16552 of 2019 in view of subsequent
events. These Writ Petitions are disposed of with the above
directions.
