   therewith the High Court be pleased to restore the above Appeal into the
   files by setting aside the order of dismissal dated 16.01.2024 abated and
   default by allowing the petitioner to prosecute the matter, for the ends
   of justice.

   affidavit filed in support thereof and this court's judgment dated
   16/01/2024 in MSA.No.30/2023 and upon hearing the arguments SRI.BIJU
