This writ appeal has been filed challenging the interim
order dated 09.04.2024 in I.A. No.2 of 2024 in W.P.(C.)
No.15485 of 2023.
2. The appellant, who was the writ petitioner
challenged a rank list prepared by the 1 st respondent for
appointment to the post of Office Attendant/Computer
Assistant. According to the appellant/writ petitioner (who was
an applicant to the post of Office Attendant), the selection
process was mala fide and the preparation of the rank list was
only intended to appoint persons on the influence of the 3 rd
respondent.
3. The learned Single Judge had initially granted an
interim order, staying appointment from the rank list. There
is an allegation that in violation of that order, certain
appointments were made and a Contempt Petition is also
pending in that regard.
4. The rank list in question was set to expire on
10.05.2024. Therefore, respondent Nos.5 to 8 in the writ
petition (respondent Nos.1 to 4 in the appeal) filed I.A No.2 of
2024, seeking the following reliefs:-
''To issue a direction allowing the applicants to promote
respondents 9 to 11 in the writ petition and to make further
appointments from the existing ranked list, during the
pendency of the Writ petition.''
On a consideration of the matter, the learned Single Judge
allowed the prayer in the interlocutory application. Through
the impugned order dated 09.04.2024, the interim order
granted earlier was vacated, making it clear that any
promotions or appointments will be subject to the final
outcome of the Writ petition and further clarifying that such
promotions/appointments will not confer any right upon the
appointees.
5. Learned counsel appearing for the appellant would
submit that the impugned order in I.A. No.2 of 2024 is
unsustainable as no reason has been stated for modifying the
earlier interim order. It is pointed out that several
appointments were made in violation of the earlier interim
order and a Contempt Petition is also pending in that regard.
It is submitted that, in such circumstances, the learned Single
Judge ought not have allowed the prayer in I.A. No.2 of 2024.
6. Learned counsel appearing for respondent Nos.1 to
4 in the appeal would submit that the prayer in I.A. No.2 of
2024 was made on account of the fact that the rank list is set
to expire by 10.05.2024 and this was clearly stated in the
affidavit in support of the Interlocutory Application. It is
submitted that if the rank list were to expire, the petitioner
would have obtained the relief of setting aside the entire
selection process on the basis of an interim order of stay as
no further appointment could have been made from the rank
list after its expiry.
7. Learned Government Pleader, on instructions,
would submit that the approval of appointments can be also
made subject to the result of the writ petition.
8. Having heard the learned counsel appearing for the
appellant, learned counsel appearing for respondent Nos.1 to
4, learned Standing Counsel appearing for respondent Nos.7
and 8, learned Government Pleader and the respective counsel
appearing for the party respondents, we are of the view that
no ground has been made out for interference with the
impugned order in I.A. No.2 of 2024 in W.P.(C.) No.15485 of
2023. The rank list in question is set to expire on 10.05.2024.
If appointments were not permitted to be made from the said
list, the persons who are included in the rank list would have
lost their right of appointment even if the writ petition were to
be ultimately dismissed. Therefore, the learned Single Judge
committed no error in allowing the prayer in I.A. No.2 of 2024
in W.P.(C.) No.15485 of 2023. The learned Single Judge has
protected the right of the appellant/writ petitioner by making
it clear that the appointments will be subject to the final
outcome of the writ petition and under no circumstances, such
promotions/appointments will confer any right on the
appointees. Therefore, the Writ Appeal will stand dismissed,
making it clear that the approval, if any, granted to the
persons who are appointed/promoted pursuant to the
impugned order in I.A. No.2 of 2024 in W.P.(C.) No.15485 of
2023 will also be subject to the result of the final orders to be
passed on W.P.(C.) No.15485 of 2023.
