THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON
18.01.2023, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:
WP(C) NO. 1574 OF 2023
-2-
JUDGMENT
Even though there are various assertions,
allegations and averments made and urged in this
writ petition, when this matter was called
today, Sri.Jayachandran - learned counsel for
the petitioner, confined his plea that 2nd
respondent - Registrar be directed to take up
and dispose of Ext.P5 representation of his
client, within a time frame to be fixed by this
Court.
2. Sri.Jayachandran explained that his
client is confident that if Ext.P5 is properly
considered by the 2nd respondent, adverting to
Exts.P3 and P4, then the claim for revision of
her earlier date of promotion could be acceded
to.
3. Sri.Manu Govind - learned Standing
Counsel for the respondents, in response,
submitted that, if the petitioner only requires WP(C) NO. 1574 OF 2023
Ext.P5 to be taken up and disposed of by the 2nd
respondent, there does not appear to be any
legal impediment in doing so; however, praying
that this Court may not make any affirmative
declarations in her favour in this judgment and
leave it to the said Authority to take an
apposite decision, as per law.
Resultantly, I order this writ petition and
direct the 2nd respondent - Registrar to take up
Ext.P5 representation of the petitioner and
dispose it of, adverting to Exts.P3 and P4,
after affording her an opportunity of being
heard; thus culminating in an appropriate order
and necessary action thereon, as expeditiously
as is possible, but not later than one month
from the date of receipt of a copy of this
judgment.
