                             JUDGMENT

The petitioner is stated to be a registered Association of

retired members of the General Reserve Engineering Force

(GREF), and they say that they are aggrieved because they are not

being offered the status of ex-servicemen, thus being denied the

benefits under the Ex-servicemen Contributory Health Scheme

(ECHS). They added that they have already preferred Ext.P7

representation before the 1st respondent and seek that it be

directed to be taken up and disposed of by its competent Authority,

within a time frame to be fixed by this Court.

2. The afore request of Sri.Balagangadharan Unikkat -

learned counsel for the petitioner, was answered by Sri.Prenjith

Kumar - learned Central Government Standing Counsel, saying

that, if the petitioner only requires Ext.P7 to be taken up and

disposed of, there does not appear to be any legal impediment for

the 1st respondent in doing so; but prayed that this Court may not

make any affirmative declarations in his favour and leave it to the

said respondent to take an appropriate decision, as per law. He

added that the question whether persons like the members of the W.P.(C).No. 21156 of 2023

petitioner association can be granted the benefit of ex-servicemen

is a matter of policy and, therefore, that sufficient liberty may be

reserved to the 1st respondent to take an apposite decision in terms

of all applicable Rules, Regulations and Circulars.

3. When I consider and evaluate the afore submissions, it is

without doubt that a decision on the claim of the petitioner can

never be taken by this Court at the first instance, while acting

under Article 226 of the Constitution of India, since it requires

evaluation of various inputs - both factual and documentary. I am,

therefore, of the firm view that Ext.P7 must be ordered to be

decided by the competent Authority of the 1st respondent.

Resultantly, this writ petition is ordered, directing the

competent Authority of the 1st respondent to take up Ext.P7

representation of the petitioner and dispose it of, after affording an

opportunity of being heard online to its President, whose name is

mentioned in the cause title; thus culminating in an appropriate

order and necessary action thereon, as expeditiously as is possible,

but not later than three months from the date of receipt of a copy

of this judgment.
