                                  JUDGMENT

Petitioner has approached this Court, being aggrieved by

the denial of interest on amounts which were refunded to the

petitioner through Ext.P2 order.

2. Learned counsel appearing for the petitioner submits

that the petitioner has a statutory right to receive interest in

terms of Section 44(4) of the KGST Act. The petitioner has

therefore preferred Ext.P4 representation before the officer who

passed Ext.P2 order, claiming interest.

3. I have heard the learned Senior Government Pleader

also.

4. Having regard to the facts and circumstances of the

case, the writ petition is disposed of, directing the 2nd

respondent to consider and pass orders on Ext.P4 in accordance

with law, after affording an opportunity of hearing to the

petitioner as well. This shall be done as expeditiously as

possible, and at any rate within two months from the date of

receipt of a copy of this judgment.
