JUDGMENT
Dated this the 2nd day of March, 2022
By judgment in WP(C) No.22673/2021 and connected
cases, the writ petitions were disposed of directing the State
of Kerala and the Director of Medical Education to grant
NOC and affiliation to the D.Pharm Courses of the
petitioners for the academic years 2019-'20 and 2020-'21. It
was made clear that the State of Kerala will be entitled to
cause inspection of the petitioners-Colleges for the purpose
of NOC/affiliation to the D.Pharm Courses of the petitioners
for the ensuing academic years and if any deficiencies are
noted, to bring the deficiencies to the notice of the petitioners
and grant reasonable time to the petitioners to make good
the deficiencies, for the purpose of approval and affiliation in
the ensuing academic years.
COC No.101/2022 in WP(C)No.22673/2021
2. The learned Government Pleader representing
the respondents filed a compliance report dated 28.02.2022,
wherein it has been stated that the consent of affiliation was
granted to the institution as early on 07.12.2020 for
conducting D.Pharm Course from 2019-'20. On the basis of
which, the LBS has allotted candidates to the College for the
academic year 2020-'21. Therefore, the directions of this
Court are complied with.
3. The learned counsel for the petitioner submitted
that this Court has directed to take steps in respect of the
petitioners-Colleges for granting NOC/affiliation for the
ensuing years also. Going through the directions contained
in the judgment in the writ petition, it is clear that this Court
has granted liberty to the State of Kerala to cause inspection
of the petitioners-Colleges for the purpose of granting NOC/
affiliation for D.Pharm Course for the ensuing academic
years. The said question will arise only in the ensuing years. COC No.101/2022 in WP(C)No.22673/2021
Therefore, this Court is of the view that no further
orders are warranted in this contempt case. Accordingly, the
Contempt of Court Case is closed.
