This petition has been filed for return of original of Exts.A1 and

A3 marked from the side of the respondents/plaintiffs. Appeal has

been filed against the judgment in A.S. No.199/2014 on the file of

Additional District and Sessions Court, Pala. It arise out of the

decree and judgment in O.S. No.117/2012 on the file of the

Subordinate Judges Court, Pala.

The suit is one for declaration of right of easement and for

consequential injunction. Respondents/plaintiffs produced Ext.A1

Sale Deed No.1706/2004 dated 23.8.2004 of SRO Ramapuram, as

well as Ext.A3 Sale Deed No.594/2005 dated 25.11.2004 of SRO

Ramapuram.

But the lower court records have not been called for in this appeal.

So as per Rule 131 of Civil Rules of Practice 1971 (Kerala) the petitioner I.A. No.1 of 2022 in R.S.A. NO.1118 OF 2016

has to approach the Additional District and Sessions Court, Pala ,

for return of the documents. (See Bulan v. Damodaran 1999 Z KLT

SN 61 (C.No.66).

Hence, petition disposed of directing the petitioner to approach

the Additional District and Sessions Court, Pala.
