     THIS OPC HAVING COME UP FOR ORDERS ON 14.09.2021 UPON PERUSING THE
LETTER DATED 18.8.2021 OF MUNSIFF, NORTH PARAVUR AND THIS COURTS JUDGMENT
DATED 19.7.2017, THE COURT ON THE SAME DAY PASSED THE FOLLOWING;

                                                                     (P.T.O)
                     V.G.ARUN, J.
              ===================
               O.P(C).No.1457 OF 2017
           ====================
      Dated this the 14th day of September, 2021

                             ORDER

By judgment dated 19.07.2017 the Original Petition is

disposed of, directing the Munsiff Court, North Paravur to

dispose O.S.No.98/2017 within a period of nine months from

the date of filing of the Commissioner's report and plan. Later,

the time limit was extended by three months vide order dated

22.07.2021.

2. By letter dated 18.08.2021, learned Munsiff has sought

further extension of the time limit. In the letter, the reasons

for extension are stated as under;

"This case came before me 1st time on 15.07.2021

and posted for commission report on 19.07.2021. Plaintiff

filed I.A.No.4/2021 on 15.07.2021 for amending the plaint

and the same was allowed on 02.08.2021 and posted on

24.08.2021 for the production of amended plaint.

I.A.No.5/2021 (Petition for prosecution) and I.A.No.6/2021

(Application for appointing advocate commissioner) were

filed on 19.07.2021 by the defendants. I.A.No.6/2021

allowed on 22.07.2021 and the commission report was

filed on 02.08.2021. I.A.No.5/2021 has been posted for

objection and hearing on 24.08.2021"

3. Learned Counsel for the petitioner submitted that the

plaintiff seeking extension of time by six months.

4. Learned Counsel for respondents 21 to 27, submitted

that the intention of the petitioner is to protract the suit

endlessly by citing large number of witnesses and submitting

applications.

Having heard the learned Counsel and having considered

the letter of the learned Munsiff, I find the request for

extension by four months to be reasonable. Therefore, the

time limit stipulated by this Court vide judgment dated

19.07.2017, as extended by order dated 22.07.2021, will stand

extended by a further period of four months from today.
