                                 JUDGMENT

This appeal came up for admission today. It is against

the order of rejection of injunction sought by the

plaintiff in a suit for injunction alleging infringement of

right under the trade mark by name 'Soura'. The interim

injunction application was rejected by the trial court on

the reason that the trade mark name 'Soura' is a generic

term, over which no right can be obtained either by way of

registration or by way of passing of. Prima facie there is

no reason to interfere with the order of the trial court.

Nothing else was brought to the notice of this court so as

to maintain the appeal herein. Hence, the appeal is

dismissed in limine.
