                               JUDGMENT

Pending consideration of an application for

renewal of permit on a curtailed route, the

petitioner submitted Ext P5 application for issuance

of temporary permit. The petitioner relies on Ext P3

order of the Appellate Tribunal whereunder he was

issued with a temporary permit valid upto

18.11.2021.

2. The application for issuance of temporary

permit, a copy of which is produced as Ext P5 in the

writ petition, indicates that it is one filed under

Section 87(1)(d) of the Motor Vehicles Act. As

noticed above, the application for renewal of the

permit on curtailed route is pending. Authorities

may consider as to whether the application is to be

considered under Section 87(1)(c) or 87(1)(d) of the

Motor Vehicles Act.

Without expressing anything on the merits, the

writ petition is disposed of directing the

respondent to consider and pass appropriate orders W.P(C) NO.24597 OF 2021

on Ext P5 application in accordance with law, with

due notice to the petitioner, as expeditiously as

possible and at any rate within a period of two

weeks.
