                            JUDGMENT

Dated this the 4th day of March 2021

The petitioner is the accused in the Crime No.1930/2020

of Marayamuttam Police Station registered for offences

punishable under Sections 55 (a) and 55 (i) of the Kerala

Abkari Act. The prosecution case is that, at around 7.10 P.M

on 07.12.2020, the petitioner was found trafficking in 49.70

liters of Indian Made Foreign Liquor in a Goods Autorickshaw.

2. Even though this application is filed seeking

pre-arrest bail, it was submitted that the petitioner is willing

to surrender before the jurisdictional court and seek bail. It

was prayed that the Magistrate may be directed to consider

the bail application on the date of surrender itself.

Considering the limited relief sought, the Bail Application

is disposed of permitting the petitioner to surrender before the

jurisdictional court and to move an application for bail, with

advance notice to the Public Prosecutor. In such event, the

learned Magistrate shall consider the bail application on the

date of surrender and pass orders thereon on the same day.
