                                JUDGMENT

Petitioner applied for temporary permit in relation to the route

Anchal-Kadakkal. Lamenting that, there was considerable delay, the

petitioner has approached this Court. The learned Senior Government

Pleader on instructions, submitted that, regular permit holder in that

route prematurely surrendered the permit on 13.07.2018. The above

timing was allotted to another existing operator on his request. In the

light of above, Ext.P1 application was rejected, submitted by the learned

Senior Government Pleader. Learned counsel for the petitioner

submitted that, he has not been issued with an order and it was

dismissed without giving him a reasonable opportunity of being heard.

In the light of the submission of the learned Government Pleader, this

Writ Petition cannot survive.

Accordingly, Writ Petition is dismissed, however, reserving the

right of the petitioner to challenge the rejection of the application on all

the grounds available to him.
