Kerala High Court
Santhosh vs The Secretary on 9 April, 2021
IN THE HIGH COURT OF KERALA AT ERNAKULAM

                              PRESENT

THE HONOURABLE MR. JUSTICE SUNIL THOMAS

     FRIDAY, THE 09TH DAY OF APRIL 2021 / 19TH CHAITHRA, 1943

                      WP(C).No.7617 OF 2021(B)

THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON
09.04.2021, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:
 WP(C).No.7617 OF 2021(B) 2

                          JUDGMENT

Dated this the 9th day of April 2021

The petitioner herein is the holder of Ext.P1 permit.

Timing is also fixed accordingly. Subsequently, he filed Exts.P4

and P5 requests for change of the timing and for accepting the

proposed timing.

According to the learned Senior Government Pleader, the

petitioner is asking for a change of timing. The proposed

timing is during peak hours and it will be extremely difficult to

grant a clash free-timing in accordance with the proposed

timing. The learned counsel for the petitioner submitted that

he is not insisting that the above timing should be strictly

adhered, if it is practically not possible. However, having

considered the submission of the learned counsel for the

petitioner, that a clash free timing in the range of the timing

proposed by him may be acceptable to him, I am inclined to

dispose of the writ petition itself by directing the respondent to

consider Exts.P4 and P5 requests and grant a clash free timing

in accordance with law, as expeditiously a possible, at any

rate, within a period of six weeks from the date of receipt of a

copy of this judgment.
