                        ORAL ORDER

This petition is filed by Dyamanna, father of alleged

detenue - Tejashwini aged about 19 years and stated that

his daughter is studying in first semester of Bachelor of

Arts at Government Degree College, Jewargi. It is also

stated that, the daughter of the petitioner - Tejashwini is

missing from 01.04.2026. Accordingly, the petitioner

lodged a complaint as per Annexure-B. In furtherance of

the same, the respondent herein has registered FIR in

Crime No.21/2026 for the offence punishable under the

provisions of Bharatiya Nyaya Sanhita, 2023 (BNS, 2023)

as per Annexure-A.

2. Since the daughter of the petitioner is missing

from 01.04.2026 and as the complaint was lodged before

the respondent, the Investigating Officer has conducted

investigation and has filed the status report before this

Court on 30.04.2026. Thereafter, on credible information

the respondent came to know that the alleged detenue -

Tejashwini was residing with one Davalappa, resident of

Jewargi, at Bengaluru and thereafter the detenue was

secured. The respondent has presented the detenue

before this Court along with WPC No.85. On enquiry, the

alleged detenue - Tejashwini stated that, on her own

volition, she left the paternal home and residing with one

Davalappa. It is also stated by the detenue that, she is

not ready to go along with her parents and she wants to

go with the aforementioned Davalappa. The statement is

accordingly recorded and in this regard paragraph No.7 of

the affidavit filed by one Ayyappa, working as Police Sub-

Inspector, Narayanpura Police Station, Narayanpura,

Hunasgi taluk, Yadagiri district is taken on record.

3. Therefore, we are of the opinion that the petition

does not survive for consideration in view of the judgment

of this Court in the case of Usharani vs. The

Commissioner of Police, Bengaluru and others reported in

ILR 2014 KAR 3312.

Accordingly, the petition is dismissed.
