ORAL ORDER
This petition is filed by accused No.1 under Section
483 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying
to grant bail in Crime No.124/2025 of Kowlande Police
Station registered for offences punishable under Sections
85, 80 and 3(5) of Bharatiya Nyaya Sanhita, 2023 and
under Sections 3 and 4 of Dowry Prohibition Act, 1961.
2. Heard learned counsel for petitioner and
learned High Court Government Pleader for respondent -
State.

3. Learned counsel for petitioner would contend
that, the marriage of the petitioner and the deceased had
taken place on 01.07.2021 and after marriage, they led a
happy married life. A child has been born and it was
underweight. Due to that, the deceased had suffered
anxiety disorder and she was taking medicine. The
deceased on 31.08.2025 filed a complaint against the
petitioner and others and it is registered in NCR
No.484/2025. At that time there was a joint statement
recorded of this petitioner and his father. In the said
complaint, there is no any allegation against the petitioner
and his family members demanding dowry and harassing
her. The said harassment is with regard to small issues.
The deceased has not left any death note. As the charge
sheet is filed, the petitioner is not required for custodial
interrogation. There are no criminal antecedents of this
petitioner. With these, he prayed to allow the petition.
4. Per contra, learned High Court Government
Pleader for respondent would contend that, the deceased

earlier filed complaint on 31.08.2025. In which she has
stated that the petitioner and his family members were
quarreling and harassing her. In the said complaint, the
petitioner and his father have given joint statement stating
that they will look after the deceased well. The said
statement is given on 07.09.2025. The deceased
committed suicide on 11.09.2025. The death of the
deceased is within seven years of marriage. The charge
sheet materials show prima-facie case against the
petitioner for offences alleged against him. With these, he
prayed for dismissal of the petition.
5. Having heard the learned counsels appearing
for parties, the Court has perused the charge sheet and
other materials placed on record.
6. The marriage of the petitioner with the
deceased has taken place on 01.07.2021. After marriage,
the petitioner and his family members have looked after
well the deceased. The deceased begot a male child. It is

alleged in the charge sheet that the deceased tied tayata
to the child and there was a galata in that regard between
the deceased and the family members of the petitioner. In
the spot mahazar, some medicine strips were found in the
purse of the deceased. Learned counsel for petitioner
submitted that, the deceased was having anxiety disorder
as the child is underweight and she was taking medicine
and, therefore the deceased might have committed suicide
due to depression. As the charge sheet is filed, the
petitioner is not required for custodial interrogation. The
petitioner has undertaken to appear before the trial Court
on all dates of hearing and abide by any conditions to be
imposed by this Court. The offences alleged against the
petitioner are not punishable either with death or
imprisonment for life.
7. Considering all the above aspects, the petitioner
has made out a case for grant of bail with conditions. In
the result, the following;

ORDER The Criminal Petition is allowed. The petitioner is
granted bail in Crime No.124/2025 of Kowlande Police
Station, subject to following conditions:
i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like-sum to the satisfaction of the trial Court.
ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly.
iii) The petitioner shall appear before the trial Court on all dates of hearing unless exempted by the Court and cooperate for speedy disposal of the case.
