                            ORAL ORDER

Learned counsel for petitioner has filed the application

under Section 320(2) R/w Section 482 of Cr.PC. seeking

permission to compound the offence.

2. Petitioner Nos.1 to 4 and respondent No.2 are

present before the Court and they are identified by the

respective counsel.

3. The application is accompanied by the joint affidavit

sworn by respondent No.2 and petitioner Nos.1 to 4. The joint

affidavit reads as under:

JOINT AFFIDAVIT

"I, USHARANI N, D/o Narashimaiah, Aged about 36 years, R/at: No.314, 9th Main Road, 6th Cross, Subedhar Palya, Yashawanthpura, Bengaluru-560022 and 2. B.C.RAMESH, S/o. S.B Chikkaboregowda, Aged 54 years, R/a No.649, gth D Main Road, 4th B Cross, 2nd Stage, Hampinagar, Vijay Nagar, Bangalore 560040, MR. MUNIRAJU, aged about 53 years, S/o Shri. Appaiah, Residing at No.64, Amruthahalli, Bangalore- 560092, MR. NARASIMHAMURTHY, aged about 50 years, S/o Shri Chennappa, R/a No. 114, 17th Cross, N.C Layout, Vijay Nagar, Bangalore-560050 and MR. SHANMUGAM, Aged about 65 years, S/o Shri. Murugesh, R/a No.5158, HMT office quartos, Jalahalli, Bagalore-560013. do hereby solemnly affirm and state on oath as follows do hereby solemnly affirm and state on oath as follows:

1. We state that the first amongst us is the Complainant and the second of us are accused No.1 to 4/ Petitioners herein in the above case and we are acquainted with the

facts of the case and as such we are swearing this affidavit. We submit that in view misunderstanding arose between us, the present complaint came to be filed and the jurisdictional police have registered FIR against the Accused No.1 to 4./petitioners herein Subsequently We have agreed to withdraw the present complaint filed against each other. In view of the same, we do not have any objection for quash FIR in Crime No. 0005/2020 Registered by Sampangiramanagara Police Station registered for the offences, punishable under Sections 354(B), 323, 504 and 34 in the above case.

2. We state that there is no force or threat or coercion from anyone to settle the dispute and we have settled our dispute amicably.

3. We submit that the FIR was lodged out of anger and as such We pray an unconditional apology at the hands of this Hon'ble Court. We submit that in view of the settlement arrived between us now we have decided to amicably settle the dispute and intends to give quietus to the misunderstandings arose between us. We submit that no purpose will be served in continuing with the present case. Now by settling this there will be no hardship to any other party or others.

4. All this is true and correct

WHEREFORE, I respectfully prays that, this Hon'ble Court may be pleased to allow the application in the interest of justice and equity.

I, USHARANI N, B.C.RAMESH, MR. MUNIRAJU, MR. NARASIMHAMURTHY, and MR. SHANMUGAM, are the deponents herein, do hereby declare that what are stated in the above paragraphs are true to the best of ourknowledge, information and belief."

4. Learned counsel for respondent No.2 submits that

the dispute between the parties is settled amicably and he has

filed a memo along with affidavit of respondent No.2, which

reads as under:

AFFIDAVIT

"I, USHARANI N. D/o Narashimaiah, Aged about 36 years, R/at: No.314, 9th Main Road, 6th Cross, Subedhar Palya, Yashawanthpura, Bengaluru-560022, do hereby solemnly affirm and state as follows:

1. I state that I am the 2nd respondent and the complainant in Crime No. 5/2020 of Sampangi Ramanagar P.S. and I hereby state as under:

2. I state that on 21.10.2020, I lodged a complaint, and the said FIR is the subject matter of the impugned order in the above writ petition.

3. I state that I am a Kabbadi player having played at the national and international level. I was training myself at Kanteerava Stadium at the time of selection on 21.10.2020. Out of anxiety in competing with my selection, I had some heated discussion with B.C. Ramesh and few others, and a scabrous situation prevailed in the fit of emotions, which later prompted me to lodge the above said complaint and FIR under challenge. In the fit of anger and anxiety, under that situation, I made certain allegations against the accused persons under misconceptions.

4. I state that upon later reflection, I have understood that filing the complaint and registration of FIR was, in fact, not necessary. We could have resolved the differences of opinion amicably. Now, I sincerely feel that continuing with the allegations made in the complaint and the said case is not advisable and necessary.

Therefore, I wish not to continue and seek to compound/condone the same by withdrawing the allegations in the complaint.

5. I state that I have taken this stand of my own volition, without any coercion or pressure from anyone.

6. In view of the above, it is humbly prayed that this Hon'ble Court may be pleased to permit the withdrawal of the complaint and quash the FIR and all proceedings emanating therefrom, and discharge/acquit the accused persons in the interest of equity and justice.

I, USHARANI N, the deponent herein, declare that what is stated in the above paragraphs is true and correct to the best of my knowledge and belief."

5. On enquiry, the parties admit the terms of the

affidavit and submit that they have voluntarily sown the

affidavit. Respondent No.2 specifically submits that she has no

objections to quash the criminal proceedings against the

petitioners by allowing the petition.

6. Satisfied with the contention taken by the parties.

7. In view of the fact that the dispute between the

parties is settled amicably, I deem it appropriate to allow the

application filed by the learned counsel for the petitioner under

Section 320(2) R/w Section 482 Cr.PC, accordingly, the

application is allowed. The parties are permitted to compound

the offence.

8. Satisfied with the affidavit sworn by respondent

No.2. Taking into consideration all these facts and

circumstances, I am of the opinion that the petition may be

allowed by quashing the criminal proceedings initiated against

the petitioners on the basis of first information lodged by

respondent No.2.

9. Hence, I proceed to pass the following:

(i) Writ Petition is allowed.

(ii) The criminal proceedings initiated against the

petitioners in Cr.No.5/2020 of Sampangi Ramaganara Police

Station, pending on the file of the learned IX Additional CMM

Court, Nrupatunga Road, Bengalore, registered for the offences

punishable under Sections 354(B), 323, 504 R/w Section 34 of

IPC, is hereby quashed.
