2. The same are allowed in view of the memo

being filed by the learned counsel for the appellant seeking

to withdraw the appeal with liberty to file appropriate

proceedings.

3. Memo reads as under:

"I, the undersigned counsel for the Appellant by mistake & have filed above appeal. Hence, I am withdraw the above appeal, kindly liberty may be granted to file the fresh W.P (GM-CPC) in the interest of justice and equity."

4. Placing the memo filed by learned counsel for

the appellant on record, this appeal is dismissed with

liberty as prayed for.
