       This MFA is filed u/s 173(1) of MV Act against the
judgment and award dated 06.06.2019 passed in MVC
No.986/2018 on the file of the Principal Senior Civil Judge and
Member, MACT-IV, Davanagere, partly allowing the claim
petition for compensation and seeking enhancement of
compensation.

      This MFA coming on for orders, this day, judgment was
delivered therein as under:

                        ORAL JUDGMENT

1. The claimant, being dissatisfied with the

compensation of Rs.2,25,000/- awarded by the

Tribunal, is in appeal.

2. The fact that the accident occurred and the

liability of the insurer to pay the compensation is

not in dispute.

3. In order to arrive at the aforementioned sum,

the Tribunal has assessed the disability at 8% on

the basis that the doctor who has examined stated

that the claimant had suffered disability to a

particular limb to the extent of 25%. In my view,

and having regard to the age of the claimant and

his avocation as an agriculturist, it would be

appropriate to take the permanent disability as

10%.

4. The tribunal has adopted the national income

of Rs.9,000/-. Since there was no proof of actual

income, in such cases the sum of Rs.11,000/-

determined by the Karnataka State Legal Services

Authority ('the KSLSA' for short) for accidents of

the year 2017 will have to be adopted.

Consequently, towards 'loss of future income', the

claimant would be entitled to the following sum.

Rs.11,000/- x 12 x 17 x 10% = Rs.2,24,400.00.

5. The Tribunal has awarded a sum of Rs.2,200/-

towards medical expenses. Since the same is

based on evidence, the same is affirmed.

6. The sum of Rs.10,000/- is awarded towards

food, nourishment, attendant and conveyance

charges is just and proper, and is accordingly

affirmed.

7. The Tribunal has awarded a sum of

Rs.30,000/- towards 'pain and sufferings', and

Rs.10,000/- towards 'loss of amenities'. Taking

into consideration that the claimant was

hospitalized for 10 days and suffered two fractures

and the disability is assessed at 10%, it would be

appropriate to enhance said sums to Rs.50,000/-

and Rs.30,000/-.

8. Since the income is now taken as Rs.11,000/-,

the sum of Rs.27,000/- awarded towards 'loss of

income during the laid-up period' is enhanced to

Rs.33,000/- (11,000X3).

9. Consequently, the award of the Tribunal is

modified and the claimant would be entitled to the

following compensation:

10. Thus, the claimant is held entitled to the total

compensation of Rs.3,49,600/- as against

Rs.2,26,000/-, along with interest at the rate of

6% per annum from the date of petition till its

realization.

11. The Insurance Company is directed to deposit

the amount of compensation awarded within two

months from the date of receipt of a certified copy

of this judgment.

12. The disbursement of the compensatio n

amount shall be in terms of the award of the

Tribunal.

13. This appeal is accordingly allowed in part.
