    THIS APPEAL, COMING ON FOR ORDERS, THIS DAY, THE
COURT DELIVERED THE FOLLOWING:

                        JUDGMENT

Learned counsel for the appellant is present.

2. This appeal is filed by the

appellant/complainant challenging the acquittal of the

respondent/accused passed by the Sessions Court by

reversing the conviction imposed by the Trial Court for the

offence punishable under Section 138 of N.I.Act.

3. As per the order dated 18.12.2023, learned

counsel for the respondent reported that appellant is no

more. Thereafter, several adjournments were granted to

bring legal heirs of appellant/complainant on record. Now,

learned counsel for the appellant has filed memo seeking

permission of this Court to retire from this appeal and he

has produced the copy of E-mails exchanged between him

and L.Rs. of appellant and also copy of endorsement of

return of the file from the appellant counsel.

4. In light of the same, learned counsel for

appellant is permitted to retire from the appeal and the

appeal is dismissed as abated.

5. In view of dismissal of appeal, all pending

application/s, if any is/are also disposed of, since no

further orders is required.
