JUDGMENT
1. The learned counsel for the appellants has filed a
memo dated 8.12.2023 seeking leave of this Court to
withdraw the appeal with liberty to file a fresh
application under Section 166 of the Motor Vehicles
Act, 1988 (for short 'the Act') before the Tribunal.
2. The memo is placed on record.
3. Accordingly, the appeal is dismissed as
withdrawn with liberty to the appellants to file fresh

application under Section 166 of the Act before the
Tribunal.
4. However, it is made clear that if the claimants
succeeds, they shall not be entitled for interest for the
delayed period i.e., from the date of filing the claim
petition under Section 163-A of the Act before the
Tribunal, till the date of filing the claim petition under
Section 166 of the Act.
5. All pending applications, if any, shall stand
disposed of.
