ORDER
The order sheet shows that the counsel for
the parties are continuously absent. This appeal
arises out of judgment of acquittal passed by the
Magistrate for the offence under section 138 of the
Negotiable Instruments Act. Since the appeal
arises out of a private complaint and it appears
that the appellant is not interested, appeal is
dismissed for non-prosecution.
