                     JUDGMENT

Learned counsel appearing for appellant has filed a

memo seeking permission to withdraw appeal as not

pressed.

2. Appellant has also prayed for entire Court fee

deposited in this appeal to be refunded.

3. Placing said memo on record, appeal is

dismissed as not pressed.

4. Registry is directed to refund entire Court fee

paid on appeal memorandum to appellant. The said

amount shall be transmitted to the account of appellant on

appellant filing an affidavit specifying details of Bank,

Branch, IFSC Code and enclosing a copy of passbook. On

such affidavit being filed, within seven (07) days from said

date, amount shall be transmitted to the account of

appellant.
