NO.35 OF 2003 ON THE FILE OF THE ADDITIONAL SENIOR
CIVIL JUDGE, AND JMFC, K.G.F. DISMISSING THE PETITION
FILED UNDER SECTION 12 OF THE HINDU MARRIAGE ACT.

     THIS MISCELLANEOUS FIRST APPEAL COMING ON FOR
ADMISSION THIS DAY, NAGARATHNA, J., DELIVERED THE
FOLLOWING:

                      JUDGMENT

This appeal has been listed on several dates. On

24.09.2020, there was no representation on behalf of both

the sides. Once again, the position remained the same on

05.10.2020. There was no representation on behalf of

both the sides. Hence, the matter was listed on

12.10.2020. On 12.11.2020, there was no representation

on behalf of the appellant. In the interest of justice, the

matter was ordered to be listed on 23.11.2020.

Thereafter, the matter was listed on other dates. Today,

the matter has been called out twice. Once again, there is

no representation on behalf of the appellant.

2. In the circumstances, it appears that the

appellant is not interested in prosecuting this appeal. The

appeal is hence dismissed for non prosecution.
