This Criminal Appeal is filed under Section 378(4)
Cr.P.C. praying to set aside the judgment and order dated
08.08.2019, passed by the JMFC III at Shivamogga in
C.C.No.1286/2016, acquitting the respondents/accused for
the offence punishable under Section 138 of the N.I.Act.

This Criminal Appeal coming on for orders this day,
through video conferencing the court made the following:
ORDER
Counsel for the appellant submits that for
complying with the office objections, he tried to
contact his client, but he has not responded. He also
submits that he tried to contact the appellant who was
appearing for the appellant in the trial court and it was
brought to his notice that the advocate is also dead.
Therefore it is his submission that he is not able to
contact his client. He says he has no objections if the
appeal is dismissed. Therefore appeal is dismissed.
