and learned A.P.P.

2. This application has been preferred by the appellant for grant

of bail to him during the pendency of this appeal.

3. The appellant has been convicted for the offences under

Sections 70(2), 115(2)/3(5) & 351(3)/3(5) of the B.N.S., 2023 and

Section 6 of the POCSO Act and has been sentenced to undergo

imprisonment for life, which shall mean imprisonment for the

remainder of the convict's natural life alongwith the fine of Rs.

50,000/- for the offence under Section 6 of the POCSO Act.

4. It has been alleged that daughter of the informant was

subjected to gang rape.

5. Submission has been advanced by learned counsel for the

appellant that the informant has become hostile and the medical

report does not support the factum of rape.

6. Regard being had to the fact that in the test identification

parade, the victim has identified this appellant as one of the persons

Page | 1 who had committed rape upon her and the FSL report has supported

the said fact, we are not inclined to admit the appellant on bail.

Accordingly, the prayer for bail of the appellant hereby stands

rejected at this stage.

7. The aforesaid I.A. stands rejected.
