03/25.03.2026 Heard learned counsel for the petitioner and learned A.P.P for the State.

2. The Petitioner has approached this Court for grant of regular bail in connection with Deoghar (Town) P.S. Case No. 22/2023, registered for the offence under Sections 302/34 of I.P.C.

3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on account of suspicion and personal enmity. He further submits that the petitioner is not named in the F.I.R and no incriminating article has been recovered from his possesson. He further submits that other co-accused person, Dharambir Singh, having same and similar allegation has already been granted bail by Co-ordinate Bench of this Court vide order dated 29.09.2023 in B.A. No. 8561 of 2023. He further submits that the petitioner is having no criminal antecedent and he is languishing in custody since 15.12.2025; as such, the petitioner may be enlarged on bail. He lastly submits that the petitioner is ready to abide by every condition as imposed by this Court.

4. Learned A.P.P opposes the prayer for bail of the Petitioner.

5. Having regard to the facts of the case and looking to the allegation made against this petitioner,

coupled with the fact that co-accused person having same and similar allegation has already been granted bail by Co-ordinate Bench of this Court and also the fact that the petitioner is languishing in custody since 15.12.2025; I am inclined to enlarge the Petitioner on bail. Accordingly, the above-named Petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Deoghar, in connection with Deoghar (Town) P.S. Case No. 22/2023.

6. It is made clear that the Petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against this Petitioner, learned trial court shall be at liberty to cancel the bail of this Petitioner.
