08/19.03.2026 Heard Mr. Birendra Kumar, learned counsel for the petitioner and learned A.P.P. The petitioner is an accused in connection with Murhu P.S. Case No. 56/2024.

The informant was subjected to gang rape by unknown miscreants. The petitioner seems to have been implicated on the confession of Markus Bodra and Maryanus Bodra.

Submission has been advanced by the learned counsel for the petitioner that the petitioner was never put on Test Identification Parade and the findings recorded in the impugned order that the petitioner was identified in the T.I.P. by the victim appears to be erroneous. Learned counsel adds that the petitioner is in custody since 05.11.2024.

Learned A.P.P. has opposed the prayer for bail of the petitioner.

On a perusal of the Case Diary as well as Supplementary Case Diary, it seems that what has been submitted by the learned counsel for the petitioner with respect to non-holding of the TIP so far as the petitioner is concerned, is correct. The implication of the petitioner, therefore, is confined to the confessional statement of Markus Bodra and Maryanus Bodra.

Regard being had to the above, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like

amount each to the satisfaction of learned District & Addl. Sessions Judge-I-cum-Special Judge (POCSO), Khunti in connection with Murhu P.S. Case No. 56/2024.

This application stands allowed.
