03/30.01.2026 Heard learned counsel appearing for the petitioner as well

as the learned counsel appearing for the State.

2. The petitioner is apprehending his arrest in connection with

Jamtara Cyber Crime P.S. Case No.69 of 2025 for the alleged

offences registered under Sections 111(2)(b), 317(2), 317(4),

317(5), 318(4), 319(2), 336(3), 338, 340(2) and 3(5) of Bharatiya

Nyaya Sanhita, 2023 and Section 66(B)(C)(D) of Information

Technology Act and Section 42(3)(e) of Telecommunication Act,

2023, pending in the Court of learned Special Judge, Cyber Crime,

Jamtara.

3. Learned counsel appearing for the petitioner submits that

false allegation is made against the petitioner and the name of the

petitioner has come on the confessional statement of apprehended

co-accused. He further submits that even the Aadhar Card and PAN

Card recovered from the possession of his father and brother was in

the name of the petitioner and that was not of another person. He

further submits that the petitioner has got no criminal antecedent

as disclosed in paragraph No.28 of the petition. He then submits

that the petitioner was doing job in a restaurant at Pune and that

has been stated in paragraph No.30 of the petition.

4. Learned counsel appearing for the State opposes the prayer

and submits that the name of the petitioner has come on the

confessional statement.

5. Considering that PAN Card and Aadhar Card recovered from

the possession of the father and brother of this petitioner was of

the petitioner and that was not of the other persons and the

petitioner has got no criminal antecedent as disclosed in paragraph

No.28 of the petition and it has been pointed out that the petitioner

is doing the work in a restaurant at Pune in the State of

Maharashtra and he has come to the home village on holidays and

in that view of the matter the petitioner is directed to surrender

before the learned Court within two weeks and the learned Court

shall release the petitioner on such terms and conditions or the

sureties as the learned Court may deem fit and proper.
