04/10.02.2026      Heard learned counsel appearing for the petitioner and learned counsel

            appearing for the State.

2. The petitioner is apprehending his arrest in connection with Complaint

Case No.35172/2025, registered for the offence under Rule 54 of Jharkhand

Minor Mineral Concession Rules, Rule 9, 11 of Jharkhand Minerals

(Prevention of Illegal Mining, Transportation and Storage) Rules, 2017 Section

4 read with 21 of MMDR Act, 1957, pending in the Court of the learned

A.C.J.M., Ranchi.

3. Learned counsel appearing for the petitioner submits that false

allegation is made against the petitioner of carrying 100 cft. sand on the

tractor. He further submits that the petitioner is happened to be owner cum

driver of the tractor. He next submits that the petitioner was carrying mud on

the said tractor for his own use. He next submits that the petitioner is having

no criminal antecedent, as disclosed in paragraph 13 of this application.

4. Learned counsel appearing for the State opposed the prayer and

submits that the allegations are there of illegally carrying 100 cft. sand.

5. Considering that the petitioner is the owner cum driver of the tractor

and he has got no criminal antecedent, as disclosed in paragraph 13 of this

application and it has been pointed out that the sand was not being carried,

however, mud was being carried for his personal use and in that view of the

matter, the petitioner is directed to surrender before the learned Court within

two weeks from today and the learned Court shall release the petitioner on

such terms, conditions or sureties as the learned Court may deem fit and

proper.

6. Accordingly, this application is disposed of.
