03/ 10.02.2026: Heard learned counsel for the petitioners and learned

counsel for the State.

2. The petitioners are apprehending their arrest in connection

with Godda (M) P.S. Case No. 198/2025 registered under sections 191(2),

191(3), 190, 126(2), 109, 76 of the BNS, pending in the Court of learned

C.J.M, Godda.

3. Learned counsel for the petitioners submits that the petitioners

have been falsely implicated in this case. He next submits that occurrence is

alleged to have been taken place on 08.11.2025 whereas F.I.R has been

registered on 14.11.2025. He further submits that there are general and

omnibus allegation of assault against the petitioners and in the impugned

order injury has not been disclosed. He submits that petitioners have got no

criminal antecedent which is disclosed in para 13 of the petition. On these

grounds, he submits that the petitioners may kindly be provided privilege of

anticipatory bail.

4. Learned counsel for the State opposes the prayer and submits ( 2026:JHHC:3471 )

that allegations of assault are there.

5. Looking into contents of F.I.R it transpires that there are general

and omnibus allegation of assault against all the accused persons, the

occurrence is alleged to have been taken place on 08.11.2025 whereas F.I.R

has been registered on 14.11.2025 and in the impugned order injury has not

been disclosed. Further, the petitioners have got no criminal antecedent

which is disclosed in para 13 of the petition.

6. In the attending facts and circumstances of the case, I am inclined

to grant anticipatory bail to the petitioners. Accordingly, the above named,

petitioners are directed to surrender before the learned court within three

weeks from today and in the event of their surrender / arrest, the

petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/-

(twenty five thousand) each with two sureties of the like amount each, to

the satisfaction of learned C.J.M, Godda, in connection with Godda (M) P.S.

Case No. 198/2025, subject to conditions as laid down under Section 482 (2)

of B.N.S.S, 2023.
