05/06.02.2026          Heard learned counsel appearing for the petitioner and learned counsel
              appearing for the State.

2. The petitioner is apprehending his arrest in connection with Bishnugarh P.S. Case No.243/2024, registered for the offence under Sections 316(2), 318(4), 351(2) of the BNS and Section 3/4 of D.P. Act, pending in the Court of the learned Judicial Magistrate, 1st Class, Hazaribagh.

Learned counsel appearing for the petitioner submits that false allegation has been made against the petitioner of establishing relationship and taking up of money with motorcycle and not marrying with the informant. He further submits that on the other hand, the petitioner has paid Rs.1,90,000/- to the informant and mother of the informant.

4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of taking up money and establishing relationship and not marrying with the informant.

5. Considering that the nature of allegation and further major lady has established relationship with the petitioner and Annexure-2 are the bank transaction, which prima facie, suggest that the petitioner has paid certain amount to the informant and mother of the informant and in that view of the matter, the petitioner is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms, conditions or sureties as the learned Court may deem fit and proper.

6. Accordingly, this application is disposed of.
