1. Heard learned counsel for the parties.
2. The learned counsel for the parties fairly accept that the issues
raised in this petition stand answered against the petitioner in the
case of M/s. Shiv Kumar Prasad v. State of Jharkhand and Others,
W.P. (C) No. 4503 of 2025 and connected matters, disposed of by
judgment and order dated 25.09.2025.
3. Therefore, by adopting the reasoning in the above judgment
and order, we dismiss this petition without any order of cost.
4. However, consistent with the observations in paragraph
158 of the above-referred judgment and order, even in this petition,
we clarify that it will be open to the petitioner to approach the
prescribed authority for refund of security deposit, if any. If such
representation is made, the same should be disposed of within a
maximum of three months from its receipt. Further, if there is any
dispute regarding such refund, the petitioner is given a liberty to
invoke the arbitration clause, if the petitioner so desires.
5. With the above liberty, this petition is disposed of.
6. Pending Interlocutory Applications are also disposed of.
