04/16.04.2026     Heard Mr. Atanu Banerjee, learned counsel for

the appellant and learned Spl. P.P. for the State.

This interlocutory application has been preferred by the appellant for grant of bail to him during the pendency of this appeal.

The appellant has been convicted for the offences u/s 376, 506 of the Indian Penal Code and has been sentenced to undergo imprisonment for life along with a fine of Rs. 20,000/- for the offence u/s 376 of the Indian Penal Code.

It has been alleged that when the informant was returning home with a bunch of woods the appellant had forcibly taken her towards the bushes and subjected her to rape.

Submission has been advanced by the learned counsel for the appellant that though the place of occurrence is a rough surface but no external injuries were found on the person of the victim which belies the case of the prosecution. It has further been submitted that the age of the victim has been assessed to be between 17-18 years and there has been a delay of two days in lodging the First Information Report.

Learned Spl. P.P. has opposed the prayer for bail of the appellant.

The victim has been examined as P.W.2 and she has categorically stated about the manner in which the appellant had caught hold of her and had subjected her to rape in the bushes. So far as the medical report is concerned, the age of the victim has been assessed to be 17-18 years and though no external injury was found on the person of the victim but an injury mark was found on the inner side of the vulva area which is suggestive for occurrence of sexual abuse as opined by the concerned Doctor.

Regard being had to the above, we are not inclined to admit the appellant on bail. His prayer for bail is hereby rejected.

I.A. No. 2906 of 2026 stands rejected.
