38/06.04.2026 I.A. No.14345 of 2025 This interlocutory application has been filed for granting opportunity to the appellant for adducing additional evidence.

2. The learned counsel for the appellant has submitted that fresh order on additional evidence was passed by the learned trial court pursuant to order dated 26.03.2025, and therefore, the appellant is entitled for adducing additional evidence in rebuttal and for that purpose, I.A. No.14345 of 2025 has been filed.

3. However, from perusal of the interlocutory application, nothing has been disclosed as to what additional evidence the appellant is seeking to adduce.

4. To this, the learned counsel for the appellant submits that he may be permitted to withdraw this interlocutory application and he shall file a fresh one disclosing the additional evidence he wants to adduce.

5. With respect to the aforesaid prayer of withdrawal and filing a fresh petition, the learned counsel for the respondents has no objection, but he submits that if a fresh interlocutory application is filed, he shall file a response to the same, which may be considered on merits.

6. In view of the aforesaid prayer made by the learned counsel for the appellant, I.A. No.14345 of 2025 is permitted to be withdrawn with a liberty to the appellant to file a fresh one, inter alia, mentioning the additional evidence, which the appellant seeks to adduce.

7. Post this case on 12.05.2026.
