04/ 13.10.2025: Heard learned counsel for the petitioner and learned counsel for the State.

2. I.A. No.5884 of 2025 has been filed for suspension of sentence and release the petitioner on bail during the pendency of the instant criminal revision.

Learned counsel appearing for the petitioner submits that the learned Chief Judicial Magistrate, Garhwa by judgement dated 22.04.2024 held the petitioner guilty under section 25(1-B)a/35 and 26/35 of Arms Act in connection with Garhwa P.S. Case No. 293 of 2023, corresponding to G.R. Case No. 746/2023, and further sentenced the petitioner to undergo S.I. for four years and fine of Rs. 10,000/- and in default of payment of fine petitioner will further undergo S.I. for six months for the offence under section 25(1-B)a of Arms Act and further R.I. for two years with fine of Rs. 10,000/- and in default of payment of fine further three months R.I for the offence under section 26 of the Arms Act and all the sentences were directed to run concurrently. He further submits that said judgment was challenged before the learned Sessions Judge, Garhwa in Criminal Appeal No. 18/2024 and by judgment dated 01.03.2025 the learned appellate court has been pleased to dismiss the appeal and affirmed the judgment of learned trial court.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 29.06.2023 and he has already completed more than two years of sentence and the maximum sentence is four years. He further submits that no bail was granted and in the meantime trial has been concluded. He submits that the petitioner may kindly be enlarged on bail after suspending the sentence.

5. Learned counsel for the State submits that looking into trial court record it transpires that petitioner has completed half of the sentence.

6. In view of above and considering that the petitioner has already completed half of the sentence and this criminal revision petition is pending and in the attending facts and circumstances of the case, during pendency of this criminal revision petition, the petitioner above named, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Garhwa in connection with Garhwa P.S. Case No. 293 of 2023, corresponding to G.R. Case No. 746/2023, subject to the condition that one of the bailor must be own relative.

7. I.A. No.5884 of 2025 is allowed and disposed of.

8. Let it appear after eight weeks under the appropriate heading.
