1. The present interlocutory application has been filed under section 5 of the Limitation Act for condonation of delay of 72 days in filing the present appeal.
2. The learned counsel for the respondent has got no objection.
3. It is stated in paragraph no.4 onwards to the present interlocutory application that after the information given by the respondent to the appellant on 3.10.2024, the appellant obtained the certified copy of the impugned judgment on 7.12.2024 and also from 22.12.2024 to 1.1.2025 the Court was closed for winter vacation. It is further stated that delay in filing the appeal is neither intentional nor deliberate but due to various reasons beyond the control of the appellant.
4. Having been satisfied with the reasons stated above, delay of 72 days in filing the present appeal is hereby condoned.
5. Accordingly, the present interlocutory application being IA No. 1370 of 2025 is allowed.
