4/09.10.2025     Learned counsel appearing for the opposite party No.2 seeks a

          week's time to file counter affidavit.

2. Learned counsel appearing for the petitioner submits that the

petitioner is not the husband of the opposite party No.2. To buttress

his argument, he refers to the Judgment passed in Sessons's trail Case

No.01 of 2016 and submits that O.P. No.2 has stated that his husband

is Motilal Hembrom and he also draws the attention of the Court to

the voter list as contained in page 28 of the revision petition and in the

voter list also, the name of the husband of O.P. No.2 is Motilal

Hembrom. He further submits, in spite of that, the learned Court has

issued NBW against the petitioner. He next submits that the said order

has been passed ex-parte and the notice has not been received by the

petitioner and the said petition has been filed under Section 125 of

Cr.P.C. in Original Maintenance Case No.22 of 2023.

3. In view of the above, a week's time is allowed to the O.P. No.2

to file the counter affidavit.

4. Let this matter appear on 17th November 2025.

5. Till then, no coercive step shall be taken against the petitioner in

connection with Original Maintenance Case No.22 of 2023 and the

NBW shall be kept in abeyance.

6. In view the above, prayer made in I.A. No.12567 of 2025 for

stay is allowed and the same is disposed of and in view that I.A.12596

of 2025 has become infructuous and as such I.A. No.12596 of 2025

also stands disposed of as infructuous.
