Heard the parties.

2. This anticipatory bail application under Section 482 of the

Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been

preferred by the petitioner apprehending his arrest for offences

registered under Sections 406 and 420 of the Indian Penal

Code in connection with Complaint Case No. 535 of 2023

pending in the court of learned Judicial Magistrate, 1 st Class,

Godda.

3. Learned A.P.P. representing the State opposes the prayer

for anticipatory bail.

4. This case arises out of complaint. The allegation against

the petitioner is that he got the account of the complainant

opened and thereafter taken the money from the same. It is

alleged that the complainant did not knew that loan was taken

from his account in the year 2019. Only when the notice of

default came to him he could know about this act.

5. Since the case arises of compliant there is no question of

custodial investigation. Further cognizance has already been

taken and summons have been issued.

6. In view of the judgment passed by the Hon'ble Supreme

Court in the case of "Arnesh Kumar vs. State of Bihar"

reported in (2014) 8 SCC 273 and "Satender Kumar Antil

vs. CBI and Anr." reported in (2022) 10 SCC 51, I direct the

petitioner to appear before the trial Court since there is no

question of arrest in this case and take appropriate steps.

7. Accordingly, this Anticipatory Bail Application stands

disposed of.
