1. The instant interlocutory application has been filed on behalf of the appellant for suspension of sentence and grant of ad interim bail, during pendency of the instant appeal.

2. Earlier the prayer for bail of the appellant was rejected on merit in I.A. No.7429 of 2019 vide order dated 13.11.2019.

3. This criminal appeal has been filed against the judgment of conviction and order of sentence dated 15.03.2019 and 16.03.2019 respectively passed by learned Additional Sessions Judge-XIII, Jamshedpur in connection with S.T. No.300 of 2017 arising out of Mango (Olidih) P.S. Case No.419 of 2016, corresponding to G.R. No.3390 of 2016, whereby the appellant has been convicted for the offence under Section 302 of the Indian Penal Code and sentenced to undergo R.I. for life with a fine of Rs.15,000/- for the offence under Section 302 IPC for the murder of Manju Kumari and further sentenced to undergo R.I. for life with a fine of Rs.15,000/- for murder of Dwij Kumar. In default of payment of fine, the appellant was directed to undergo six months additional imprisonment and all the sentences were directed to be run concurrently.

4. Learned senior counsel for the appellant has submitted that the appellant has remained in custody since 25.11.2016 i.e around nine years. On the basis of this fact, prayer for suspension of sentence has been made.

5. Learned Spl. P.P. has opposed the prayer.

6. Considering the period of custody, we are inclined to suspend the sentence and enlarge the appellant on bail, on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XIII, Jamshedpur in connection with S.T. No.300 of 2017 arising out of Mango (Olidih) P.S. Case No.419 of 2016, corresponding to G.R. No.3390 of 2016, subject to the conditions that the appellant will remain present before the Court when the appeal is taken up for hearing, failing which his bail shall be cancelled.

7. I.A. No.13714 of 2025 stands allowed and disposed of.
