th 18/Dated:18 August, 2025 It appears that vide judgment and sentence dated 18.12.2021 the appellant has been convicted under Section 25(1-B)a/35 & 26 of the Arms Act and sentenced to undergo R.I for three (03) years for the offence under section 25)1-B)a/35 of the Arms Act and to pay fine of Rs.1,000/- and R.I. for two (02) years for the offence under Section 26 of Arms Act and to pay fine of Rs.1,000/.

2. It reveals from the I.A. No.3533 of 2022 that the appellant was on provisional bail 18.12.2021 for a period of one month.

3. It further appears that the appeal was filed on 22.04.2022 and the Co-ordinate Bench (Justice Navneet Kumar) of this Court had adjourned the matter on 16.03.2023, 28.04.2023, 12.05.2023 and 04.07.2023.

4. It further reveals that vide order dated 11.11.2024 passed by the Co-ordinate Bench (Hon'ble Mr. Justice Sanjay Kumar Dwivedi) of this Court that Mrs. Nivedita Kundu, had appeared on behalf of the appellant and submitted that she is not able to contact. Thereafter the State was directed to take steps for service of notice upon the appellant and the matter was adjourned on 27.11.2024 and 16.12.2024.

5. However, on 16.12.2024, Ms. Sonal Sodhani, learned counsel appeared on behalf of the appellant before the

Co-ordinate Bench (Hon'ble Mr. Justice Sanjay Kumar Dwivedi) of this Court and submitted that she will file fresh Vakalatnama.

6. It appears that the appeal has been adjourned on several dates on behalf of the appellant and even after changing the learned counsels, the appellant is not attending the Court deliberately.

7. It appears that the provisional bail of the appellant has expired three years ago and the appellant is traceless.

8. Under the circumstances, the learned Court below is directed to issue N.B.W against the appellant for his arrest and shall submit report before this Court within six weeks.

9. Put up this case after six weeks preferably in the 1st week of October, 2025.
