1. An affidavit has been filed on behalf of the State on 09.04.2025 sworn by one Aman Kumar Singh, Sub-Inspector
-cum- O.C, Bharkatta O.P, Birni P.S. Giridih, stating therein that one of the appellants, namely, Bahadur Mandal @ Lakhpatia Mandal, appellant No.12 of the present appeal, has died on 16.01.2025. The aforesaid statement has been supported by death certificate, appended as Annexure-1 to the supplementary affidavit.
2. No application has been filed through the legal heirs to pursue the appeal.
3. Accordingly, the appeal is abated so far as it relates to the appellant No.12, namely, Bahadur Mandal @ Lakhpatia Mandal is concerned.
4. Heard Mr. P. K. Mukhopadhyay, learned counsel, appearing on behalf of the appellants and Mr. Satish Prasad, learned A.P.P, appearing on behalf of the State.
5. Hearing concluded.
