07 /19.09.2024: I.A. No.3507 of 2024 This interlocutory application has been filed by the appellant, praying therein to suspend the sentence and release him on bail during the pendency of this appeal.

2. The appellant has been convicted for the offence under Section 302 of IPC, in connection with Sessions Trial No.33 of 2021. He has been sentenced to undergo rigorous imprisonment for life with a fine of Rs.10,000/-, for the offence under Section 302 of IPC.

3. Heard, learned counsel for the appellant and learned A.P.P. for the State and have gone through the impugned judgment, the evidence and the Trial Court Records.

4. Opportunity was given to the State to oppose the bail, which the State availed and opposed.

5. Though there is no eye witness, who had seen this appellant assaulting the deceased, but immediately after the occurrence, P.W.-1 had reached the place of occurrence and had seen the deceased lying in a pool of blood and this appellant standing with bamboo stick. Stick of bamboo was sent to the Forensic Science Laboratory along with the apparels of the deceased and the blood in the apparels of the deceased matched with the blood, which was found in the bamboo stick.

6. Considering the nature of this evidence, we are not inclined to release the appellant on bail.

7. Accordingly, I.A. No.3507 of 2024 stands dismissed.
