05/15.10.2024 The matter relates to the judgment of conviction dated 04.04.2014

and order of sentence dated 04.04.2014 passed by the learned District and

Additional Sessions Judge-II-cum-Special Judge, CBI, Dhanbad in R.C. Case

No.3(A)/1990-D.

2. Mr. Mukesh Bihari Lal, learned counsel for the appellant submits that

I.A. No.8460 of 2024 has been filed praying therein that this appeal is

abated as the appellant has left for his heavenly abode on 07.04.2024.

3. Mr. Anil Kumar, learned A.S.G.I., appearing for the CBI accepts the

said submission.

4. In view of the above, the prayer made in the I.A. is allowed.

5. Accordingly, I.A. No.8460 of 2024 is disposed of.

6. Consequently, this appeal is abated.

7. Let the L.C.R. be sent back to the concerned Court forthwith.
