06/23.10.2024 Mr. Navin Kumar, learned counsel, under the instruction of Mr. V.K. Dubey, learned arguing counsel, prays for time.

2. It appears that this is a case of abduction of a minor victim girl. It appears that at the time of admitting the appeal on 17.06.2005, Notice was not issued upon the Informant.

3. Under the circumstances, learned counsel for the appellant is directed to implead the Informant as 'X', who is the father of the victim girl.

4. Let notice be served upon the Informant, i.e. the father of the victim girl in the light of the judgment reported in "Nipun Saxena and another v. Union of India and others" reported in (2019) 2 Supreme Court Cases 703 through the Senior Superintendent of Police, Hazaribagh.

5. Learned counsel for the appellant is directed to serve a copy of the Memo of Appeal to the learned A.P.P. within a week from today.

6. Put up this case on 11th December, 2024.

7. In the meantime, learned A.P.P. shall also get served the Notice upon the Informant of this case through the Senior Superintendent of Police, Hazaribagh and also through Officer-in-Charge of the concerned police station.

8. Let a copy of this order be sent to the Office of the Senior Superintendent of Police, Hazaribagh by Fax at once and also be served to the learned Special P.P. for the needful.

9. Learned Special P.P. shall also file an affidavit through the concerned Police Station regarding service of Notice upon the Informant of this case.

10. Put up this case on 11th December, 2024.
