1. The issue herein as has been answered by the learned

Tribunal is as to whether the respondent namely, Ratan Kumar

Kapoor is entitled for the pay scale attached to the post of the

Accounts Officer by virtue of the fact that he has not been holding

the substantive post of the Accounts Officer, rather, as Assistant

Accounts Officer, but he has been asked to discharge duty to the

higher post of Accounts Officer in In-charge capacity.

2. Learned Additional Solicitor General of India has

submitted that he is required to go into the judgments based upon

which the learned Tribunal has passed order and the related rules

regarding the applicability of the aforesaid judgments, hence, he

has sought for time.

3. As prayed for, list this case on 29.01.2024.
